1. Aceptaci贸n de Condiciones en el TPV
Al procesar un pago a trav茅s de nuestro Terminal Punto de Venta (TPV) o cualquier pasarela de pago en sgpcard.com, el cliente manifiesta su acuerdo expreso, libre e inequ铆voco con estas Condiciones de Compra, as铆 como con nuestras Pol铆ticas de Privacidad, Env铆os y Devoluciones. Este documento tiene valor de contrato legal vinculante entre el cliente y SMART GLOBAL PROJECTION. La formalizaci贸n del pago equivale a la firma electr贸nica de la aceptaci贸n total de nuestras pol铆ticas de blindaje comercial.
2. Precios y Pasarelas de Pago
Todos los precios mostrados en el sitio web est谩n sujetos a cambios sin previo aviso. Nos reservamos el derecho de modificar el coste de los productos o de cancelar promociones de manera unilateral. El importe total ser谩 cobrado en el momento exacto en que se formaliza el pedido mediante nuestras pasarelas de pago cifradas. El cliente certifica que es el titular leg铆timo de la tarjeta o medio de pago utilizado.
3. Impuestos, Aduanas y Aranceles (DDU)
Los precios mostrados no incluyen impuestos locales de importaci贸n ni aranceles. Todo pedido se procesa bajo el modelo DDU (Delivery Duty Unpaid). El cliente es el 煤nico responsable legal y financiero de liquidar el IVA, tasas aduaneras o aranceles exigidos por su pa铆s. En caso de que las autoridades confisquen, retengan, devuelvan o destruyan el paquete por impago de impuestos o normativas de importaci贸n locales, SMART GLOBAL PROJECTION no realizar谩 reembolsos de ning煤n tipo.
4. Pol铆tica de Env铆os y Riesgo Comercial
En el segundo exacto en que entregamos el paquete a la agencia de transportes log铆stica, la propiedad y todo el riesgo de p茅rdida o da帽o se transfiere incondicionalmente al comprador. No nos hacemos responsables de retrasos log铆sticos, robos tras la confirmaci贸n de entrega (Porch Piracy) o p茅rdidas derivadas de direcciones proporcionadas de manera incorrecta por el usuario. El cliente asume el compromiso de revisar nuestra Pol铆tica de Env铆os completa en la web.
5. Restricci贸n Absoluta de Cancelaciones
Nuestro sistema log铆stico es altamente automatizado. Una vez que se pulsa el bot贸n de “Pagar” y el TPV aprueba la transacci贸n, el pedido entra inmediatamente en fase de ensamblaje o expedici贸n log铆stica. Por consiguiente, no se aceptan cancelaciones de pedidos por arrepentimiento del cliente tras el cobro. Si por motivos puramente t茅cnicos o administrativos excepcionales se permitiera una cancelaci贸n manual a discreci贸n de la empresa, esta acarrear谩 una penalizaci贸n fija del 15% del valor total por gastos de gesti贸n y tarifas no reembolsables de las pasarelas de pago.
6. Condiciones de Preventas (Pre-Orders)
En los art铆culos marcados como “Preventa” o “Pre-order”, el cobro se realiza por adelantado al momento de la compra para asegurar su unidad en el lote de fabricaci贸n. Las fechas de lanzamiento y entrega indicadas en la web son puramente estimativas. Dado que fabricamos prototipos experimentales, el I+D y la cadena de suministro pueden sufrir retrasos imprevistos. Bajo ninguna circunstancia los retrasos en las entregas de productos en preventa ser谩n motivo v谩lido de cancelaci贸n o reembolso. El cliente que compra una preventa asume la posibilidad de modificaciones en la fecha final de expedici贸n.
7. Pol铆tica de Devoluciones y Desistimiento (14 D铆as)
En cumplimiento con las normativas de las pasarelas de pago y leyes de consumo aplicables, ofrecemos a todos nuestros clientes un plazo de 14 d铆as naturales desde la recepci贸n del paquete para iniciar solicitudes de devoluci贸n. Sin embargo, al ser nuestros dispositivos prototipos experimentales ensamblados de manera marcadamente artesanal, las devoluciones por simple arrepentimiento (desistimiento no justificado) estar谩n sujetas a una rigurosa revisi贸n t茅cnica y a posibles penalizaciones por reacondicionamiento comercial.
Para garantizar una cobertura total sin penalizaciones, las reclamaciones por roturas graves de origen (DOA) o defectos de f谩brica deben notificarse imperativamente dentro de estos primeros 14 d铆as naturales con pruebas gr谩ficas contundentes, tal y como dictamina nuestra Pol铆tica de Devoluciones.
8. Garant铆a Limitada y Naturaleza de Prototipo
Los productos vendidos son herramientas experimentales y prototipos, no bienes de consumo final de car谩cter comercial general. Por ello, se venden estrictamente “TAL CUAL” (As Is), sin garant铆as de comerciabilidad o idoneidad para un fin concreto. Nuestra garant铆a comercial solo cubre defectos flagrantes de hardware inicial. La garant铆a queda nula, de forma inmediata e irreversible, ante cualquier indicio de inyecci贸n de software no autorizado, modificaci贸n f铆sica, mala manipulaci贸n o mal uso.
9. Limitaci贸n Total de Responsabilidad
LA EMPRESA NO SE HACE RESPONSABLE DEL USO INDEBIDO O MAL USO DE ESTOS DISPOSITIVOS.
El uso principal y exclusivo es educativo y de investigaci贸n legal. En la medida m谩xima permitida por la ley, SMART GLOBAL PROJECTION y sus directivos quedan eximidos de cualquier responsabilidad por da帽os directos, indirectos, especiales, incidentales o consecuentes que resulten del uso, mal uso, o incapacidad de uso de nuestros productos. Nuestra responsabilidad m谩xima agregada frente a cualquier reclamaci贸n, sea cual sea su naturaleza jur铆dica, nunca exceder谩 el importe exacto que el cliente pag贸 originalmente por el producto en nuestro TPV.
10. Prevenci贸n de Fraude Bancario (Chargebacks)
La Empresa dispone de un sistema avanzado antifraude. La presentaci贸n de una disputa de cargo bancario (“Chargeback”) falsa, maliciosa o injustificada (por ejemplo, afirmar que no se autoriz贸 la compra tras recibir el producto o intentar eludir nuestras estrictas pol铆ticas de no-devoluci贸n) ser谩 considerada fraude comercial. En estos casos, enviaremos al banco y a las autoridades todas las pruebas log铆sticas, IPs de compra, aceptaci贸n de estos t茅rminos y v铆deos de embalaje, reserv谩ndonos el derecho a presentar demandas civiles para recuperar los costes, tasas bancarias y honorarios legales.
11. Modificaci贸n Unilateral de los T茅rminos
SMART GLOBAL PROJECTION se reserva el derecho absoluto y unilateral a actualizar, enmendar o modificar estos T茅rminos y Condiciones de Compra en cualquier momento. Las modificaciones entrar谩n en vigor inmediatamente en el momento de su publicaci贸n en el sitio web. Es responsabilidad del cliente revisar peri贸dicamente esta p谩gina.
12. Legislaci贸n Aplicable y Sumisi贸n a Fuero
El presente contrato comercial se regir谩 por la legislaci贸n espa帽ola. El cliente renuncia expresa e irrevocablemente a cualquier otro foro, tribunal internacional o jurisdicci贸n de consumo extranjera que le pudiera corresponder. Cualquier controversia, demanda o problema legal originado en relaci贸n a una compra realizada en nuestra web, se someter谩 de forma exclusiva y excluyente a la jurisdicci贸n de los Tribunales correspondientes al domicilio fiscal de SMART GLOBAL PROJECTION en Espa帽a.

1. Acceptance of Terms at POS
By processing a payment through our Point of Sale (POS) terminal or any payment gateway on sgpcard.com, the customer expresses their clear, free, and unequivocal agreement with these Purchase Conditions, as well as with our Privacy, Shipping, and Return Policies. This document holds the value of a binding legal contract between the customer and SMART GLOBAL PROJECTION. Formalizing the payment equals an electronic signature of total acceptance of our commercial shielding policies.
2. Pricing and Payment Gateways
All prices displayed on the website are subject to change without prior notice. We reserve the right to modify the cost of products or cancel promotions unilaterally. The full amount will be charged at the exact moment the order is formalized through our encrypted payment gateways. The customer certifies that they are the legitimate owner of the card or payment method used.
3. Taxes, Customs, and Duties (DDU)
The prices shown do not include local import taxes or duties. Every order is processed under the DDU (Delivery Duty Unpaid) model. The customer is solely legally and financially responsible for settling the VAT, customs fees, or duties required by their country. If authorities confiscate, hold, return, or destroy the package due to non-payment of taxes or local import regulations, SMART GLOBAL PROJECTION will not issue refunds of any kind.
4. Shipping Policy and Commercial Risk
The exact second we hand over the package to the logistics transport agency, the ownership and all risk of loss or damage are unconditionally transferred to the buyer. We are not responsible for logistical delays, thefts after delivery confirmation (Porch Piracy), or losses resulting from incorrectly provided addresses by the user. The customer commits to reviewing our full Shipping Policy on the website.
5. Absolute Restriction on Cancellations
Our logistics system is highly automated. Once the “Pay” button is pressed and the POS approves the transaction, the order immediately enters the assembly or dispatch phase. Therefore, no order cancellations due to customer remorse are accepted after payment collection. If, for purely exceptional technical or administrative reasons, a manual cancellation is permitted at the company’s discretion, it will incur a fixed penalty of 15% of the total value for management expenses and non-refundable payment gateway fees.
6. Pre-Order Conditions
For items marked as “Pre-order,” payment is collected upfront at the time of purchase to secure your unit in the manufacturing batch. Release and delivery dates indicated on the website are purely estimates. Given that we manufacture experimental prototypes, R&D and the supply chain may experience unforeseen delays. Under no circumstances will delays in the delivery of pre-order products be a valid reason for cancellation or refund. The customer who purchases a pre-order assumes the possibility of changes in the final dispatch date.
7. Return and Withdrawal Policy (14 Days)
In compliance with payment gateway regulations and applicable consumer laws, we offer all our customers a period of 14 calendar days from the receipt of the package to initiate return requests. However, as our devices are experimental prototypes assembled in a distinctly artisanal manner, returns due to simple buyer’s remorse (unjustified withdrawal) will be subject to a rigorous technical review and possible restocking/refurbishment penalties.
To guarantee full coverage without penalties, claims for severe origin breakages (DOA) or manufacturing defects must imperatively be notified within these first 14 calendar days with conclusive graphical evidence, as dictated by our Return Policy.
8. Limited Warranty and Prototype Nature
The products sold are experimental tools and prototypes, not general commercial end-consumer goods. Therefore, they are sold strictly “AS IS”, without warranties of merchantability or fitness for a particular purpose. Our commercial warranty only covers blatant initial hardware defects. The warranty is voided, immediately and irreversibly, at any sign of unauthorized software injection, physical modification, mishandling, or misuse.
9. Total Limitation of Liability
THE COMPANY IS NOT RESPONSIBLE FOR THE IMPROPER USE OR MISUSE OF THESE DEVICES.
The primary and exclusive use is educational and for legal research. To the maximum extent permitted by law, SMART GLOBAL PROJECTION and its officers are exempt from any liability for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use our products. Our maximum aggregate liability against any claim, regardless of its legal nature, will never exceed the exact amount the customer originally paid for the product at our POS.
10. Bank Fraud Prevention (Chargebacks)
The Company has an advanced anti-fraud system. Submitting a false, malicious, or unjustified bank chargeback dispute (e.g., claiming the purchase was not authorized after receiving the product, or trying to bypass our strict no-return policies) will be considered commercial fraud. In these cases, we will send the bank and authorities all logistical proofs, purchase IPs, acceptance of these terms, and packaging videos, reserving the right to file civil lawsuits to recover costs, bank fees, and legal expenses.
11. Unilateral Modification of Terms
SMART GLOBAL PROJECTION reserves the absolute and unilateral right to update, amend, or modify these Purchase Terms and Conditions at any time. Modifications will become effective immediately upon posting on the website. It is the customer’s responsibility to periodically review this page.
12. Governing Law and Jurisdiction
This commercial contract shall be governed by Spanish law. The customer expressly and irrevocably waives any other forum, international court, or foreign consumer jurisdiction that might correspond to them. Any dispute, claim, or legal issue arising in connection with a purchase made on our website shall be submitted solely and exclusively to the jurisdiction of the Courts corresponding to the tax domicile of SMART GLOBAL PROJECTION in Spain.
